Rights Afforded Under the VHRA & the ADA

Here in the Commonwealth of Virginia, employees with disabilities are protected from discrimination under both the Virginia Human Rights Act (amended by the Virginia Values Act) and the Americans with Disabilities Act. Employees who wish to bring a claim against their employer may do so either under the VHRA or the ADA. To bring a discrimination claim under the ADA, among other requirements, you will have to prove that you (a) have a disability defined specifically by the law and (b) can perform the essential functions of your job, with or watthour a “reasonable accommodation.”  Some examples of “reasonable accommodations” may be as follows:

  • making the workplace wheelchair accessible
  • allowing a disabled employee the time to receive certain medical care (doctor’s appointments, necessary treatments, etc.)
  • providing assistance for a hearing-impaired individual

You should note, however, that there are exceptions. For example, if your employer can prove that accommodating your condition would bear an unreasonable or extremely costly burden (known as an “undue hardship”) on the company, you may not have a claim.
