Do I Need a Chesterfield County Whistleblower Protection Attorney?

When an individual is retaliated against for reporting wrongdoing, he or she should not have to fight the uphill battle alone. Our firm supports whistleblowers and the work they do.

Retaliation for Whistleblowing

When someone reports an illegal activity conducted by their employer, they may be entitled, under certain state and federal laws, to not face retaliation for doing so. Unfortunately, whistleblowers often still do face retaliation for such actions. Some of the most common forms of retaliation against whistleblowers are as follows:

  • Demotions
  • Reducing their pay
  • Blacklisting
  • Wrongful termination
  • Other types of disciplinary action

Virginia’s Whistleblower Law

According to Virginia’s whistleblower law, effective July 1, 2020, employees are protected from retaliation if they either report a violation of any law or regulation or refuse to participate in a criminal act or an act that would violate a federal or state law or regulation. Employees are also protected from retaliation if they participate in an investigation, hearing, or inquiry into a company that was requested by a governmental body or law enforcement. Finally, employees are protected from retaliation for providing information or testifying before a governmental body or law enforcement agency regarding an alleged violation of state or federal law on the part of their employer.

You should also understand that whistleblowers here in the United States are protected from retaliation under federal law as well; namely the Sarbanes-Oxley Act and the False Claims Act. If you believe you’ve been subjected to worker retaliation, our firm is here to help.
